Manchester solicitor Pannone has released a guide to the new Public Contracts (Amendment) Regulations 2009.
The guide explains changes following the EU Remedies Directive 2007/66, which came into force in the UK from 20 December last year.
Under the new regulations:
- In addition to an award of damages, courts have new powers to declare a contract "ineffective" and set aside contracts that have been awarded in serious breach of the procurement rules;
- The courts may award damages and/or shorten a contract as an alternative to ineffectiveness if it considers that there is an overriding public interest for the contract to continue;
- A contract award procedure will be suspended automatically whenever legal proceedings are started in respect of a contract award decision;
- There are changes to the standstill procedures that assist aggrieved bidders in seeking remedies before the contract is awarded.
